Resolution Opposing an Article V Convention

   Whereas the Constitution Party of West Virginia believes that an Article V convention for the purpose of proposing amendments to the Constitution is a dangerous idea and that it is being presented to West Virginia legislators and their constituents in a deceptive manner;

   Whereas the promoters of an Article V convention (A5C) assure us that the states alone have the authority to set the agenda, define the rules, select the delegates, etc. for a convention but the truth is that these assurances are only “wishful thinking” as this is all still being debated, with many scholars, Supreme Court justices and the Congressional Research Service believing that the states will only “apply” for a convention, then the Congress will take over and “call” the convention including establishing the rules and, therefore, nobody can predict with certainty how these questions will be answered;

   Whereas a convention is not likely to be limited to a single issue and, in fact, most resolutions combine several issues; 

   Whereas delegates to a convention will not be chosen by, or accountable to, “We The People” as long as we have questionable un-secured elections; 

   Whereas there is nothing to prevent a convention from becoming a “runaway convention” that completely re-writes our Constitution—as the first convention in 1787 did after it was called only to make revisions to the Articles of Confederation;

   Whereas an amendment requiring “term limits” will not solve the problem of corrupt, greedy and traitorous congressmen, which can only be solved by voters with access to sufficient, truthful information electing a better caliber of representatives;

   Whereas the “out-of-control spending” problem can be easily solved by restricting government’s spending to its Constitutionally enumerated authority and, in fact, the Balanced Budget Amendments do nothing but put a stamp of approval on un-Constitutional spending items and include loopholes that would actually allow Congress to spend more;

   Whereas both the federal congress and state legislatures are guilty of ignoring the limitations imposed by the Constitution and are equally to blame for the current situation;

   Whereas enemies of the Constitution have taken over the federal government and would love a new Constitution which legalizes what they plan to do;

   Whereas the Constitution is not the problem, but is the finest document ever written for guiding free people in self-government and the problem is that corrupt people have ignored it, even made “end-runs” around it, for their own benefit; and

   Whereas the state has a solemn duty to protect the liberty of our people and is required by the Tenth Amendment to resist federal intrusion and to nullify un-Constitutional laws and edicts; now, therefore, be it

   Resolved, that the Constitution Party of West Virginia urges the West Virginia Legislature to reject all applications for an Article V convention and to rescind the application made in 2016.
